PRIVACY POLICY

The protection of personal data is very important to Médiaperformances, and we pay special attention to it.

The purpose of this policy is to explain the processing of personal data carried out by Médiaperformances, in compliance with the applicable regulations: Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter the “GDPR”) and the amended French Data Protection Act.

This privacy policy applies to individuals with whom Médiaperformances comes into contact (or who come into contact with Médiaperformances) in the context of its business relations with them or their employer (employees of our customers, suppliers, service providers, partners) but also to individuals who use the website: https://mediaperformances.com (hereinafter “the Site”).

 

WHAT IS PERSONAL DATA?

Personal data is any information relating to an identified or identifiable individual; an “identifiable individual” is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

 

WHO IS THE DATA CONTROLLER?

The data controller is the individual or organisation who determines the purposes and means for processing data, i.e., the objective and the way in which it is carried out.

The processing of personal data covered by this policy is carried out by: MEDIAPERFORMANCES, SAS, headquartered at Tour Alto – 4 place des Saisons 92400 COURBEVOIE and registered with the Trade and Companies Register of Nanterre under number 332 403 997.

 

WHAT DATA IS PROCESSED?

– As part of its business activities, Médiaperformances may process the personal data of representatives of partners, suppliers, service providers, customers and prospects, or of candidates for hire.

The data that may be processed is as follows:

– identity: first name, last name, company name,

– contact details: postal address, e-mail address, telephone number,

– professional details: position, job title.

– payment information, including invoices and payment details.

This data may be transmitted via various communication channels (e-mail, telephone) or as part of our relationship (execution of a contract, commercial prospecting, a meeting within as part of our business activities, participation in an event, etc.).

– As part of the proper functioning of its website https://mediaperformances.com (hereinafter referred to as “the Site”), the personal data that Médiaperformances may collect are as follows:

– identity: name, company name,

– contact details: e-mail address,

– self-qualification or orientation data: advertiser, distributor, press, candidate, other.

– other data may be collected, such as IP addresses, coupled with the pages consulted and the dates and times of consultation, as well as cookies (for more details, please read the cookies charter available here)

This data can be transmitted:

  • by the person themself using the contact form,
  • through cookies and other Internet trackers used on the Site.

 

WHAT ARE THE PURPOSES, LEGAL BASES AND DURATION OF DATA PROCESSING?

Any identification that may be sent is:

IS THE COLLECTION AND PROCESSING OF YOUR DATA REQUIRED?

Certain data is essential for the management and execution of orders or contracts.

 

In the case of marketing communications, if the data subjects no longer wish to receive information about the activities and services of Médiaperformances, they may object at any time via the unsubscribe link included in each marketing e-mail.

 

To respond to requests sent via the Contact section of the Site, the name and e-mail address are essential.

To exercise your rights, you may be asked to provide information or documents proving your identity or additional information on the nature of your requests.
Failure to do so may prevent Médiaperformances from responding to your requests.

 

TO WHOM MAY MEDIAPERFORMANCES TRANSMIT YOUR DATA?

The data collected is communicated to the Médiaperformances departments concerned by your request (sales, human resources, etc.).
Your data will only be used by Médiaperformances.

Nevertheless, in the event that one of Médiaperformances’s departments outsources its data processing activities to subcontractors to provide services, these will be chosen with regard to their sufficient guarantees as to the implementation of appropriate technical and organisational measures, particularly in terms of reliability and security measures.

Where applicable, Médiaperformances undertakes to transfer personal data outside the European Union only in strict compliance with Regulation (EU) 2016/679 and Act no. 78-17 of 6 January 1978, as amended.

When you interact with links or advertisements available on our Site and directing to other sites, social networks or applications, it is possible that the third parties operating these sites, services or advertisements, in their capacity as separate data controllers, may process your personal data under their own responsibility.

WHAT RIGHTS DO YOU HAVE?

– Right of access and rectification:

You have the right to obtain confirmation as to whether or not your personal data is being processed, the right to access it if necessary, and to request a copy.

You also have the right to request that this data be completed or corrected.

– Right of opposition and deletion of personal data:

You have the right to object at any time and without justification to the processing of your personal data.

Your data will be deleted from Médiaperformances’s databases in accordance with the terms and conditions set out in the regulations governing personal data, subject to legal retention obligations.

– Right to restrict processing

In the event of a dispute concerning the processing of your personal data, you may request that the processing of the data be suspended for the time required to investigate the dispute.
In this case, Médiaperformances will no longer use your data until the dispute has been resolved.

You can exercise this right if you object to the processing or if you dispute the accuracy of the personal data used.

– Right to portability of personal data

You may request the transfer of personal data shared with Médiaperformances to another data controller in a structured, commonly used and readable format, within the limits provided for by the regulations relating to personal data.
In this case, they will be transferred to the recipient of your choice.

– Right to lodge a complaint with the CNIL.

You can take your complaint to the French supervisory authority, the CNIL (Commission Nationale de l’Informatique et des Libertés), by lodging a complaint.

Any request relating to the processing of personal data and to exercising your rights should be sent to:

No payment is required to respond to requests relating to the exercise of the aforementioned rights.
However, in accordance with Article 12 of the GDPR, where a data subject’s requests are manifestly unfounded or excessive, in particular due to their repetitive nature, Médiaperformances may require the payment of reasonable fees that take into account the administrative costs incurred in providing the information, proceeding with the communications or taking the measures requested or refusing to comply with such requests.

Your request will be processed within one month.
If necessary, this deadline may be extended by two months, depending on the complexity and number of requests received by Médiaperformances.

SECURITY

Médiaperformances implements all appropriate technical and organisational measures to guarantee the security of your data.
Our security measures include firewalls, anti-virus software, staff access controls and regular software updates.

MODIFICATIONS

This Privacy Policy may be updated to take account of changes in applicable regulations or in the event of changes in the methods of processing personal data carried out by Médiaperformances.

These modifications will apply as of the effective date of the modified version.
